1. Natural Materials & Organic Material Variance

At Pixelated NorthWest LLC, we take immense pride in utilizing premium, locally sourced raw materials, including but not limited to Cedar, Red Alder, Russian Olive, Spruce, and Slate. Wood and stone are natural products. By purchasing from us, the client acknowledges that every raw piece features distinct grain patterns, knots, mineral streaks, unique textures, and organic characteristics. These are not flaws; they are the unique markers of authentic craftsmanship. Pixelated NorthWest LLC is not liable for, and will not issue refunds based on, natural variances in wood grain, minor structural shifts over time due to climate changes, or the specific way organic materials absorb our custom-blended water-based paints and stains.

2. Custom Project Proofing and Approvals

For all custom signage, business branding, and commissioned artwork, final digital proofs will be provided to the client for layout, text, spelling, and design verification. The client’s explicit approval of this digital proof constitutes a binding contract. Pixelated NorthWest LLC utilizes surgical-grade laser calibration down to a millimeter scale to execute the approved design exactly as displayed in the proof. Consequently, Pixelated NorthWest LLC is not responsible or liable for any typographical, layout, design, or scaling errors discovered after the client has given final proof approval. Custom or personalized orders cannot be returned, cancelled, or refunded once production has commenced.

3. Intellectual Property & Fan Art Disclaimer

• Independent Craftsmanship & Non-Affiliation: Pixelated NorthWest LLC is an independent creator of custom artwork, signage, and multi-layered geographical travel maps. All designs, stadium interpretations, and tracking maps are original artistic renderings crafted by Pixelated NorthWest LLC. Unless explicitly stated otherwise, Pixelated NorthWest LLC is not affiliated, associated, authorized, endorsed by, or in any way officially connected with the National Football League (NFL), Major League Baseball (MLB), National Basketball Association (NBA), National Hockey League (NHL), National Collegiate NCAA, or any of their respective teams, properties, or corporate stadium naming entities.
• Trademark Disclaimer: All product names, logos, brands, and other trademarks or images featured or referred to within the products and website of Pixelated NorthWest LLC are the property of their respective trademark holders. Use of any specific city names, landmark configurations, or descriptive terminology is strictly utilized for geographical and historical identification purposes by the artist and does not imply any connection or endorsement.

4. Client-Submitted Artwork & Intellectual Property Rights

• Right to Use and Authorization: When a client submits logos, graphics, trademarks, or copyrighted artwork to Pixelated NorthWest LLC for custom engraving, manufacturing, or signage development, the client explicitly warrants and represents that they are the sole owner of, or possess the legal, authorized license and right to use, reproduce, and display such artwork.
• Right of Refusal: Pixelated NorthWest LLC reserves the absolute right to refuse any custom order containing artwork, text, or imagery that appears to infringe on federal trademarks or copyrights, or that contains explicit or defamatory material.
• Client Indemnification: The client agrees to defend, indemnify, and hold entirely harmless Pixelated NorthWest LLC from and against any and all claims, actions, demands, liabilities, losses, costs, or legal expenses (including attorney’s fees) arising out of or related to any third-party allegations of trademark or copyright infringement resulting from the manufacturing, engraving, or reproduction of artwork submitted to us by the client.

5. Digital Display, Color, & Sizing Variances

Because our products are displayed digitally on our online storefront, the colors of apparel, stains, paints, and raw materials may appear slightly different in person depending on your computer monitor or mobile device’s screen settings. For all apparel products, clients must consult the provided sizing charts prior to ordering. Pixelated NorthWest LLC is not responsible or liable for size exchanges or refunds due to incorrect size selection by the client.

6. Limitation of Liability

All commercial transactions, custom agreements, and digital purchases are conducted strictly with the legal entity of Pixelated NorthWest LLC. Any and all liabilities are restricted entirely to the assets of the LLC corporate entity.
